Highlights for this Week:

Higher Education Appropriation Bill Passes GCCA

 

Late Thursday afternoon, HB 2433, which contains the language for the appropriation to higher education, was signed out of both the House and Senate GCCA (General Conference Committee on Appropriations.)  The bill appropriates $806.5 million for higher education.  For more information, see the story below.  A separate bill (HB 2587; text unavailable at this time) still pending action by the Legislature contains “Rainy Day” fund appropriations totaling $58.2 million for higher education – $13.4 million for FY’02 supplemental funding and $44.8 million for FY’03 purposes.

GCCA Process Starts to Move Again

(GIT)  With the House taking up redistricting measures on Thursday, Rep. Mike Mass, D-Hartshorne, called the House GCCA conferees into a meeting and moved many appropriations bills out of the committee.

            Both the House and Senate GCCA conferees approved the following measures on Thursday, authored by Rep. Mike Mass, D-Hartshorne, and Sen. Kelly Haney, D-Seminole:

            HB 2433 appropriates $850,936,016 to the State Regents for Higher Education, a $9,539,531 or 1.1 percent cut.

            HB 2553 appropriates $40,897,067 to the District Courts, a $74,208 or 0.2 percent cut.

            SB 1003 relates to school employees' use of the flexible benefit allowance.

            SB 1043 eliminates certain fees charged by the Oklahoma Securities Commission.

            SB 1067 modifies number of judges for certain judicial districts.

            SB 1210 relates to the Common Education Technology Fund.

            SB 1045 appropriates $29,648,836 to the State Department of Agriculture, Food and Forestry, a $571,875 or 1.97 percent increase.

            SB 1174 appropriates $7,227,380 to the State Election Board, a $380.388 or 5 percent cut.

            HB 2502 relates to the Department of Human Services authority to expend certain funds.

            The House General Conference Committee on Appropriations conferees approved the following appropriations bills Thursday:

            HB 2453 appropriates $15,301,061 to the Department of Central Services, an $893,087 or 5.5 percent budget reduction.

            HB 2459 appropriates $8,912,398 to the Office of State Finance, a $6,235,174 or 41.2 percent cut.

            HB 2499 relates to the Oklahoma Health Care Authority, extending certain time periods for staffing requirement of nursing facilities.

            HB 2513 appropriates $10,515,233 to the Oklahoma Historical Society, a $332,000 or 3.6 percent cut.

            HB 2514 appropriates $357,805 to the Oklahoma Scenic Rivers Commission, which mirrors the current year's budget.

            HB 2523 appropriates $28,177,594 to the Oklahoma Tourism and Recreation Department, A $4,814,874 or 14.59 percent cut.

            HB 2524 relates to the Quartz Mountain Revolving Fund.

            HB 2525 appropriates $8,069,143 to the Oklahoma Water Resources Board, a $392,711 or 4.64 percent cut. The bill also relates to the Rural Economic Action Plan Water Projects Funds.

            HB 2548 modifies appropriations to the Office of the Attorney General.

            HB 2592 directing transfers of certain funds by certain entities and officers.

            SB 1035 appropriates $396,126,375 to the Oklahoma Health Care Authority, a $22,552,889 or 5.4 percent cut.

            SB 1164 authorizes the Office of Juvenile Affairs to request exemptions from expenditure limitation and budgetary limitation for unanticipated federal funds.

            SB 1202 relates to state employees in the unclassified positions.

            The Senate conferees also approved SB 1415, which makes changes to Oklahoma's sales tax code.

            Neither the House nor the Senate approved SB 1096 relating to the Department of Corrections appropriations. Each committee wanted to amend the bill, and sent it back for further conference.

 

 

HB2738 Signed by the Governor

 

HB 2738, which relates to the Quartz Mountain Lodge and Conference Center and expands eligibility for the OHLAP (Oklahoma Higher Learning Access Program) program to students attending non-accredited high schools, was signed by the Governor on Wednesday.  The final signed version of the bill can be found at:

House Split on Congressional Redistricting Plans

(GIT)  Hours after failing to pass the Senate's Congressional Redistricting plan, the House approved a compromised version of a House plan Thursday.

            The House plan was passed after the Senate's version had failed earlier in the day. SB 1683, by Sen. Stratton Taylor, D-Claremore, and Rep. Loyd Benson, D-Frederick, divides the state into five Congressional districts, provides an operational date for the districts and for conducting elections. The bill also repeals current Congressional districts.

            The Senate version failed by a 48-53 vote. Although the bill was voted mostly down party lines, four Democrats representing Oklahoma City and western Oklahoma voted against the bill, which provided the difference causing the bill to fail to garner enough votes.

            Reps. Jack Bonny, D-Burns Flat; James Covey, D-Custer City; William Paulk, D-Oklahoma City; and Clay Pope, D-Loyal, all voted against the Senate's version of the bill.

            Benson said the Senate plan was as good as any the House was going to be presented with, and encouraged his fellow members to pass the bill.

            "If we don't vote on some plan we are [ignoring] our responsibility as a legislative body," Benson said. "There's going to be winners and losers in each of these plans."

            A possible compromise was put together and presented in the afternoon, but the bill barely received enough votes to move to the Senate. Floor substitute for HB 1479, by Rep. Larry Adair, D-Stilwell, and Taylor, divides the state into five Congressional districts and repeals current Congressional districts.

            Passing by a vote of 51-50, the bill squeezed by despite some defections on both sides of the aisle. Reps. Ron Langmacher, D-Carnegie; Paulk; and Purcy Walker, D-Elk City; voted against the bill, but votes in favor of the measure from Reps. Wayne Pettigrew, R-Edmond, and Chris Hastings, R-Tulsa, carried it over to the Senate.

            Benson said the measure had no incumbents facing each other, something that differed from the Senate version.

            "It does everything the courts say we must do," Benson said.

            The House version had Districts One and Two sharing areas in Tulsa, while the Oklahoma City metro area was shared by Districts Three, Four and Five (maps available on LIN under the category "GIT Buzz"). District Three, which represents southeastern Oklahoma, moves into north Oklahoma City and actually extends into Warr Acres, the home for U.S. Rep. Ernest Istook.

            The Senate will likely take up the measure Friday. Governor Frank Keating, however, announced that he would veto the plan that passed the House.

            "This bill violates the key concept behind responsible redistricting, protecting communities of interest," Keating said. "The needs of rural southeastern Oklahoma are far different from those of Oklahoma City. Putting them in the same congressional district is detrimental for residents of both areas."

            Keating said Oklahoma City Mayor Kirk Humphreys also indicated that the House compromised version was not a bill that would benefit Oklahoma City, and he encouraged Keating to veto the bill as well.

SB 696 (Robinson/Vaughn) - Smoking in Public Places.  The second conference committee substitute relates to marriage and divorce data collection and smoking; providing that the owner or operator of a place where smoking or tobacco use is prohibited by law to post a sign or decal at each entrance indicating that the establishment is smoke-free or tobacco-free.  The third conference committee substitute enacts new law at Title 63, Section 1-334, and amends 21 O.S. 2001, Section 1247; requiring the Department of Health and the Administrative Office of the Courts, by Nov. 1, 2002, to begin discussions regarding the identification, collection and analysis of nonidentifiable aggregate data related to marriage and divorce in the state and to make recommendations regarding alternatives to establishment of such statistical reports to the governor and legislature by Feb. 1, 2003; removing specific requirements for no smoking signs and requiring that owners or operaters of places where smoking or tobacco use is prohibited by law be responsible for posting a sign or decal, at least four inches by two inches in size, at each entrance to the building indicating that the pace is smoke-free or tobacco-free.

SB 934 (Herbert/Glover) – COMMISSIONERS OF LAND OFFICE.  Requiring the Commissioners of the Land Office to transfer all available funds from the Public Building Fund to the State Treasurer for allocation to the State Land Reimbursement Fund each year; authorizing the Commissioners to invest the permanent school fund and the other educational funds in timber and timberland, and to buy, sell, harvest and manage timber produced on land owned by the Commissioners; modifying publication requirements for the sale of oil, gas and mineral leases on school lands; requiring the Commissioners to pay real estate appraiser license fees for employees required to obtain such license to perform required job duties.  (62 O.S. 2001 § 194; 64 O.S. 2001, §§ 51, 92, 281)  The conference committee substitute does not amend 62 O.S. 2001, § 194 or 64 O.S. 2001, §§ 51 and 281.  Now the bill only requires the Commissioners of the Land Office to publish notice of lease sales one time, not less than 30 days prior to sale, in two newspapers; requiring that leases be offered by public competition; making Commissioners responsible for the fee for obtaining a real estate appraiser’s license for any employee required to obtain such license to perform job duties.  The second conference committee substitute adds new law authorizing the Commissioners of the Land Office to invest the permanent school fund and other educational funds in timber and timberland, and to buy, sell, harvest and manage timber; requiring the commission to transfer and report all funds, less 6 percent collected in the public building fund and the Greer Fund to the Office of State Finance for deposit in the certified building fund on a monthly basis; requiring that all funds in excess of $2.5 million in the two funds be transferred to the State Land Reimbursement Fund.   http://www.lsb.state.ok.us/2001-02SB/SB934_int.rtf

SB 1233 (Morgan/Wells) – HEALTH INSURANCE PLANSProhibiting the Employee Benefits Council and the State and Education Employees Group Insurance Board from requiring HMOs to follow a standardized service area or offer a Medicare supplement plan; authorizing HMOs to exceed the basic plan in benefit design as long as they maintain uniform deductibles and co-pays as authorized by the Council and Board.  The conference committee substitute totally rewrites the bill; new law, Title 36, Section 6538.1; Title 74, Section 1366.1; amending 36 O.S. 2001, Sections 6532, 6534/6535, 6542; 74 O.S. 2001, Sections 1321 and 1365; requiring the Board of Directors of the Health Insurance High Risk Pool to adopt alternative health insurance plans that will provide options for its members; authorizing the board to offer different benefit structures; requiring the board to implement disease management programs, implement a multi-tier pharmacy benefit design, report to state officials concerning the status of the pool and make recommendations; requiring the board to select a case manager; authorizing the Oklahoma State Employees Benefits Council to renegotiate rates with successful bidders after contracts have been awarded if there is an extraordinary circumstance; requiring the Benefits Council and the Oklahoma State and Education Employee Group Insurance Board to develop geographic service areas, not require that participating HMOs offer a Medicare supplement plan and require participating HMOs to meet the standardized benefit plan; require the Oklahoma Health Care Authority to conduct a feasibility study concerning coverage
