Highlights This Week
Budget Decisions Near:
Legislative budget subcommittees continued to work today to finalize
agency appropriations as the House and Senate convened rare Friday floor
sessions. Higher education officials
have lobbied for an appropriation increase of at least $40 million. At the time of publication, no higher
education appropriation bills had been passed.
Today’s legislative activity has strategic importance related to the
constitutional requirement that the Governor act on bills within five days of
passage. Bills passed today must be
signed or vetoed by the Governor by next Thursday, giving the Legislature one
last day to address the Governor’s action.
However, any bills passed next week can held by the Governor for up to
15 days after the Legislature adjourns on May 26, depriving the Legislature of
any recourse to the Governor’s final decision.
HB 2728 Approved by Legislature,
Contains New and Expanded Scholarships: On Wednesday, the House
and Senate both passed HB 2728, the bill intended to “clean up” controversial
issues from HB 1759 of the 1999 session.
Chief among those concerns was a “dual diploma” system in HB 1759 which
linked an honors diploma with a new Oklahoma Tuition Scholarship Program
(OTSP). As passed, HB 2728 would
eliminate the honors diploma but would still implement the OTSP with modified
criteria. Despite concerns expressed by
several legislators during floor discussions, the bill passed easily on final
votes of 96-4 in the House and 47-0 in the Senate. The bill is now pending action by the Governor. Among the items contained in HB 2728 are the
following:

Implementation of the new Oklahoma Tuition Scholarship
Program. The new scholarship program
would provide an award equivalent to tuition for the first two years of college
for students graduating high school with a 3.25 GPA, an ACT score of 26, and
ranked in the top 15% of their class.
However, any state or federal tuition aid the student receives would reduce
or eliminate the award. High school
students graduating in the 2002-2003 school year would be the first students
eligible for the award.
§
Expansion of Eligibility for the Oklahoma Higher
Learning Access Program (OHLAP): The
bill increases the family income limit for students to participate in OHLAP
from $32,000 to $50,000. Under OHLAP,
students must sign up during the 8th, 9th, or 10th
grade. If they fulfill program
requirements to complete a college preparatory curriculum, earn at least a 2.5
GPA, and abide by certain conduct standards, the students are awarded a
scholarship equivalent to tuition for up to five years.

Concurrent Enrollment:
The bill defines minimum curricular requirements for high school
graduation. If a school district does
not offer sufficient courses to meet the graduation requirements, and a student
takes a concurrent enrollment course to fulfill the graduation requirements,
the district must pay the costs of the concurrent enrollment course. The bill also contains legislative intent
language that institutions charge only directly related tuition and fees for
concurrent courses. The language
requests that fees such as student activity fees, facility fees, health care
fees, etc. be waived.

Spring Break Coordination: The bill calls for the State Superintendent of Public
Instruction, the Chancellor for Higher Education and the Director of the State
Department of Vocational and Technical Education to coordinate spring break
dates for all public schools, area vo-tech schools, and colleges.

Bill Would Create Teacher Loan
Repayment Program: SB 1393, by
Sen. Charles Ford (R – Tulsa) and Rep. John Bryant (R – Tulsa), would create a
loan repayment incentive for college graduates that teach secondary math or
science for at least five years in a public school. The bill passed the Senate 45-0 on Tuesday and the House 97-0 on
Wednesday. Under the bill, a new math
or science teacher who completes the five-year service commitment would be
eligible for an award equal to three years of tuition and fees at a public
college (about $6,300 at current tuition rates). If the teacher had outstanding student loans, the award would be
paid toward the debt. Any amount above
the debt would go to the teacher.

Other Bills Sent to the Governor: Following are two other bills of particular
interest to higher education that passed both houses of the Legislature this
week and have been sent to the Governor.

lease, or use of parking privileges by state college or university

SB 1216 – provides a sales tax exemption on sales of
personal property or services for use
on college campus projects

and proposals; requires the agency, when evaluating bids and proposals from
private vendors and employees, to consider the full cost of privatizing,
including the cost of contract implementation and monitoring and transitional
costs; requires the agency to certify that the privatization is at least 10
percent below the cost of state operation and that it maintains quality

prohibits State Textbook Committee members from holding successive terms;
requires that at least four members be certified as teachers and actively
employed at the elementary level and at least four members at the secondary
