Highlights This Week
House and Senate Name Final Budget Committee Members: This week House Speaker Loyd Benson and Senate President Stratton Taylor announced the members of the General Conference Committee on Appropriations (GCCA), the joint committee responsible for finalizing the state budget. The committee is made up of five subcommittees that have budget responsibilities for specified state agencies. The Education Subcommittee, which oversees the higher education appropriation, consists of the following members:

Governor Signs Appropriation and Fee Bills: On Monday, the Governor signed both the General Appropriation Bill (HB 2260) and SB 1305, which increases the statutory limits on certain student fees. Both bills passed easily and are now pending action by the Governor.
HB 2260, the General Appropriations bill, provides $748.6 million to higher education. This amount does not replace the $23.5 million that higher education received from the state’s Rainy Day Fund for the current fiscal year. SENATE BILLS
SB 400 (Stipe/Culver) - DEGREE COMPLETION/CASH AWARDS. Authorizes the Department of Corrections to provide cash awards to employees who complete the degree requirements for an associate’s, bachelor’s or master’s level program, through an accredited college or university, in the behavioral sciences; requires that the department ensure that any employee who completes one of the specific degree programs is offered an award; prohibits any single award from exceeding $1,000 and prohibits an employee from being awarded more than $2,500 during the duration of employment with the department; limits the total of such awards to $10,000 each fiscal year; requires that any employee who accepts such cash award and voluntarily leaves employment with the department within two years must reimburse the department in full. Enacts the “The HMO Reform and Accountability Act”; makes health maintenance organizations (HMOs) liable for damages for harm to an insured or enrollee proximately caused by health care treatment decisions made by its employees, agents or representatives acting on its behalf. The floor substitute enacts the “Managed Health Care Reform and Accountability Act”; applies to health insurance carriers and other managed care entities as well as HMOs; requires health care entities to exercise ordinary care when making health care treatment decisions; makes entities liable for damages for harm to an enrollee proximately caused by breach of the duty to exercise ordinary care if such failure resulted in denial, significant delay or modification of health care service recommended for or furnished to the enrollee and the enrollee suffered harm; provides for external review.
