Highlights This Week
General Appropriations Bill Passes House: On Wednesday, the House of Representatives passed HB 2260, the general appropriations bill that provides a base level of funding for all state agencies. The bill appropriated $748.6 million for higher education, some $23.5 million less than the current year funding level. The difference is primarily due to the fact that higher education received $23.5 million from the state’s Rainy Day for the current year; the general appropriations bill does not replace the Rainy Day Funds with other appropriated revenue.
Other issues related to the general appropriations bill:
· The bill appropriates to higher education all $36.4 million available from the new Higher Education Capital Fund that receives oil tax revenue.
· The bill does not appropriate any of the $36.4 million currently available in the new Oklahoma Tuition Scholarship Fund.
· Rep. Bill Settle (D – Muskogee), Chair of the House Appropriations and Budget Committee, stated that about $228 million still remains to be allocated by the Legislature (which includes $74 million in the Rainy Day Fund and the $36.4 million in the Tuition Scholarship fund).
· All House Republicans voted against the bill which passed on a 60-38 vote.
The bill is now pending action on the Senate floor.

Amendment Would Authorize New Tuition Waiver: A bill considered in the Senate Human Resources Committee was amended to authorize a college tuition waiver for children in the custody of the Department of Human Services (DHS). Those eligible for the waiver would have to be in the custody of DHS for at least nine months between their 16th and 18th birthdays. The amendment to HB 2452 states that current high school seniors would be the first to be eligible for the waiver.

Student Fee Bill Passes House: A bill to raise the statutory limits on three special student fees passed the House on Tuesday by a 63-29 vote. SB 1305 increases the following limits:
· library automation and materials fee – from $1.50 to $2.25 per semester credit hour
· student facility fee – from $4.30 to $7.30 per semester credit hour
· student health care fee – from $46 to $54 per semester
The bill now heads back to the Senate. If the Senate votes to accept House amendments to the bill, then the bill will go directly to the Governor, bypassing the need for a joint conference committee.

Tuition Scholarship Bill Passes Senate, Heads to Conference: HB 2728, which includes the implementation of a new Oklahoma Tuition Scholarship Program, passed the Senate Monday on a vote divided along party lines. The bill passed 30-13 with all Senate Republicans voting against the bill. The bill is headed for a joint conference committee where a final version will be drafted.

Campus Security Bill Amended to Address Teacher/Student Sexual Activity: A bill authorizing higher education officials to remove persons from college campuses was amended on the House floor to include a provision related to teachers who engage in sexual activity with a student. The amendment to SB 1021 was offered by Rep. Bill Graves (R – Oklahoma City) and contains the following language:
“Upon verified information that a teacher has had any sexual activity with a student, the chief administrative officer or anyone designated by the chief administrative officer or the governing board of the institution of learning shall have the authority and power to direct the teacher to leave the institution."
A second amendment was added to the bill related to punishment for soliciting sexual conduct by means of a computer. Following the adoption of the amendments, the bill passed easily by a 95-0 vote.

SB 400 (Stipe/Culver) - DEGREE COMPLETION/CASH AWARDS. Authorizes the Department of Corrections to provide cash awards to employees who complete the degree requirements for an associate’s, bachelor’s or master’s level program, through an accredited college or university, in the behavioral sciences; requires that the department ensure that any employee who completes one of the specific degree programs is offered an award; prohibits any single award from exceeding $1,000 and prohibits an employee from being awarded more than $2,500 during the duration of employment with the department; limits the total of such awards to $10,000 each fiscal year; requires that any employee who accepts such cash award and voluntarily leaves employment with the department within two years must reimburse the department in full. SB 1206 (Henry/Settle) - HEALTH INSURANCE. Enacts the “The HMO Reform and Accountability Act”; makes health maintenance organizations (HMOs) liable for damages for harm to an insured or enrollee proximately caused by health care treatment decisions made by its employees, agents or representatives acting on its behalf. The floor substitute enacts the “Managed Health Care Reform and Accountability Act”; applies to health insurance carriers and other managed care entities as well as HMOs; requires health care entities to exercise ordinary care when making health care treatment decisions; makes entities liable for damages for harm to an enrollee proximately caused by breach of the duty to exercise ordinary care if such failure resulted in denial, significant delay or modification of health care service recommended for or furnished to the enrollee and the enrollee suffered harm; provides for external review.
